PANHANDLE BULLDOGS PUPPY PURCHASE AGREEMENT
THIS AGREEMENT for the purchase of an AKC registered English Bulldog
Puppy is entered into on _____________________ by and between April and
Todd Hort doing business as Panhandle Bulldogs (“Breeder”) whose address
is 2510 Prairie Street, Gering, Nebraska 69341 and the following Purchaser:

Purchaser has agreed to purchase the following identified Puppy:

Purchase Price
Purchaser agrees to pay the sum of $___________ for the Puppy (“Base
Purchase Price”). A non-refundable deposit of $500.00 is due upon the entering
of this Agreement. Until such deposit is actually received by the Breeder,
Breeder reserves the right to sell the Puppy to another purchaser. The balance
of the purchase price is due and payable in full on or before the Puppy reaching
the age of 7 weeks which date is _______________. Failure to pay the balance
of the purchase price in a timely manner, time being of the essence, will result in
the loss of the deposit. Said deposit being agreed to by the parties as
reasonable compensation for damages incurred by the Breeder.
In addition to the Base Purchase Price, Purchaser agrees to pay for the
following items which are initialed by the Purchaser:
________ AVID chipping (initial insertion only, additional registration fees
may apply) - $30.
________ Delivery up to 400 miles one-way at $.35 per mile for entire round
trip mileage from Breeder’s location.
________ Shipping via commercial airline (excluding Alaska and Hawaii)
from DIA for $400. Shipping will be to the major airport closest to Purchaser.
Additional costs may apply if reasonable flights and connections are not
available. Purchaser understands that bulldogs cannot be shipped in
temperatures over 75 degrees. Purchaser assumes responsibility once Puppy
is delivered to DIA and released to the transporting airline. Breeder provides the
appropriate crate, food and water containers and health certificate.
_________ Boarding at the rate of $10 per day, if Purchaser requests a delay
in the possession date of the Puppy longer than 5 days after the date the
Breeder has indicated that the Puppy will be available.
The cost of the above items shall be referred to as “Additional Purchase Price.”
The Additional Purchase Price shall be due on the same date as the Base
Purchase Price unless other arrangements have been made. If the Additional
Purchase Price is paid at the time of delivery or pickup, it shall be paid in cash.
Payments made prior to the delivery date may be made using PayPal, cash, or
money order.
Puppy Purchased
The purchased Puppy will be in good physical health as of the day that
Purchaser picks up the Puppy; the day that the Puppy delivered to Purchaser;
or, the day the Puppy is delivered to an airline for shipment. The Puppy comes
with a special folder of information which includes current vaccination, de-
worming schedule, veterinary examination, pedigree information and AKC
registration. All necessary shots and de-worming have been done. If Breeder is
unable to provide Puppy to Purchaser for any reason, Breeder may cancel this
Agreement; return the deposit paid hereunder; and, be released from any
further obligations hereunder. No puppy shall be made available until it is eight
weeks old. Purchaser understands that bulldogs are inside dogs and may
require air conditioning to prevent overheating.
Purchaser’s Responsibility
The Purchaser agrees to take the Puppy to a licensed veterinarian of Purchaser’
s choice, at purchaser’s expense, within 72 hours of receipt of the puppy for a
health check to determine that this puppy is healthy and free of any illness or
congenital/hereditary life threatening disorders. The nature and extent of the
veterinarian exam shall be determined by purchaser and the vet. If the
veterinarian determines that the Puppy is unsuitable for purchase due to an
illness, disease or congenital disorder that is clearly attributable to the Breeder
and Purchaser desires a replacement puppy, Purchaser shall follow the steps
set forth below under Replacement Policy. Purchaser waives the right to any
replacement if Purchaser fails to have the initial veterinarian exam with 72 hours
of receipt.
Puppies that are shipped are at risk for Coccidian and Kennel Cough which is
common in puppies that are shipped and are usually caused by bacteria.
Kennel cough is self-limiting and like the common cold, must run its course. Full
recovery is expected and kennel cough on its own is not life threatening. No
replacement puppy will be provided for these ailments.
Guaranty
Breeder guarantees that the Puppy will be free of Life Threatening congenital
& hereditary defects for a period of one year from the date of pick up, delivery or
shipping. Life Threatening congenital & hereditary defects do not include
worms, vitamin deficiencies, viral or bacterial diseases, distemper, hepatitis,
hypoglycemia, disorders brought on by parasites, allergies, blindness,
deafness, thyroid dysfunctions, demo deictic or red mange, loose hips or
knees, cherry eye, entropion, skin disorders, autoimmune disorders, ailments
caused by injury or abuse, improper diet, neglect, defects or injuries caused by
breeding, temperament issues, injuries or illness caused by overheating or over
exertion.Breeder does not guaranty that Puppy is suitable for showing or
breeding. Breeder guaranties against LIFE THREATENING defects only. This
guaranty is void and of no force and effect if Purchaser fails to provide routine
veterinarian care for the Puppy including, but not limited to, proper
vaccinations, routine worm checks, heart worm treatments or other care as
recommended by the veterinarian. The Guaranty is void if the Puppy is sold or
transferred.
Replacement Policy
Breeder agrees to replace the Puppy with another one of the same sex, breed
and equal value if the Puppy fails to meet the quality guaranteed under the
Guaranty or under the initial veterinarian examination provisions above and
provided that Purchaser follows the procedures set forth in this Agreement. If
no puppy is available at the time for the replacement, Purchaser shall receive a
puppy as one becomes available in subsequent litters. In no event will
Purchaser receive a refund of the purchase price.
In order to be entitled to a replacement puppy, Purchaser shall:
a. provide written notice to Breeder of the problem accompanied with a
signed letter or report from a veterinarian stating with specificity the nature of
any ailment or defect that is life threatening or which otherwise makes the
Puppy unsuitable for purchase and the likely cause of the ailment or defect;
b. provide the notice under section (a) within forty-eight hours after the initial
veterinarian exam for claims made under the Purchaser Responsibility section
above or within 1 year of purchase for claims made under the Guaranty section
above.
c. upon request make available all records, tests and results of Purchaser’s
veterinarian to Breeder or its veterinarian;
d. make the Puppy available for examination by Breeder’s veterinarian or
another veterinarian of Breeder’s choice; and,
e. return the Puppy to Breeder along with all AKC papers with the Puppy
signed over to April Hort.
Purchaser is responsible for all veterinarian charges and transportation
charges incurred. Purchaser shall not be entitled to a replacement if Purchaser
does not follow the procedures set forth in this Agreement or if Breeder after
reviewing all of the information available regarding the Puppy’s health,
determines in good faith that the condition is not a covered condition hereunder.
Breeder is confident that Purchaser and Puppy will spend many fun filled years
together. If for any reason Purchaser can no longer keep the Puppy, Purchaser
shall notify the Breeder who shall have the right, but not the obligation, to
purchase the Puppy back at the price that Purchaser is offering to sell the
Puppy to a third person or the actual value of the Puppy, whichever is less. If
the puppy has been spayed or neutered, the amount paid shall not exceed $300.
Any notice required under this Agreement shall be in writing and sent to
Breeder, certified mail, return receipt requested at Breeder’s address listed in
the introductory paragraph above. In addition a copy of said notice and any
other documents being sent shall be emailed to Breeder at
april@nebraskapanhandlebulldogs.com. Purchaser is also encouraged to
contact Breeder at (308) 765-0523 if there are any problems. However contact
via telephone shall not constitute notice under this Agreement.
In the event that there is any dispute that needs to be resolved in court, venue
for such proceeding shall be in Scottsbluff County, Nebraska. The prevailing
party shall be entitled to recover its costs of litigating, including reasonable
attorney fees. In no event shall Nebraska Panhandle Bulldogs be liable for an
amount exceeding the purchase price of the puppy.
Breeder has made no promises or representations other than those contained
in this Agreement.
This Agreement may not be assigned or transferred by Purchaser.
By signing below, Purchaser acknowledges that he or she has read and
understood the entire Agreement and that he or she understands that it is a
legally binding agreement.
